Yes — per common law, a legal marriage performed anywhere is legal everywhere and No — just because a marriage is legal somewhere doesn't mean its recognized everywhere. So, for example, if you were married in Iowa or Massachusetts and then moved to Texas, neither the state of Texas nor the federal government would recognize your marriage. Yet, when you file your tax return you'll have to file as "married, filing separately " and then include a letter with your tax return that you're filing this way, because Public Law No. 104-199, 110 Stat. 2419 prohibits your marriage from being recognized. You could be prosecuted for filing a fraudulent tax return if you marked "single " because you're not single, you're married, even though the government says they won't recognize your marriage and insists that you're single. So you see the potential legal ramifications of this problem. (totally forked up, isn't it?) |

Um last time I checked, you can't get married in California. I guess Ohio is your closest bet. And yes, you'd still be married when you come back to Texas. Edit: Or at least I thought so...the guy below me seems to a LOT more about the subject :) |

You can't get married in California anymore. They passed Prop 8 last year, making same sex marriage illegal. |

No you would not, at least not in a legal sense. Because of the 'Defense of Marriage Act' (DOMA) enacted by President Clinton, a legal gay marriage in one state or country is not automatically recognized by another state, like a straight marriage would be. This is obviously Unconstitutional under the Equal Protection provisions of the US Constitution, but so far the US Supreme Court has not chosen to rule on the matter. |
